GENERAL CONDITIONS OF ONLINE SALE

ART. 1 - The application of the general conditions of sale is limited to goods purchased at the online shop ("www.torrinijewels.com") owned and managed by Torrini 1369 srl, official licensee of the "Torrini 1369" Trademark, resident in PiazzaDuomo 12 R in Florence (IT), (here in after referred to as the Seller), by individuals persons (here in after referred to as Buyers) who act for purposes not relevant to their business or professional activity, who must be considered end users or consumers: (a) who have reached the age of majority required toenter into purchase contracts (eighteen in most countries); (b) who have the legal capacity to enter into purchase contracts; (c) that use a shipping address in the country or countries we ship to. Unless otherwise provided, minors do not enjoy the right to legally stipulate a purchase contract and are required to use their parent or legal guardian to transmit an order in their own name and will be required to accept these Conditions of sale. Any changes may be made from time to time to these General Conditions of Sale; therefore, please check them regularly to keep informed of updates. The latest version of these General Conditions of Sale will always be available on the official website www.torrinijewels.com. Any new version of these General Conditions of Sale will take effect immediately on the date of shipment and will govern orders for products or services made from that date. Changes to the Conditions of Sale subsequent to the transmission of the order will not affect the orderor the relationship with us, except as may be required by applicable law.

ART. 2 - All orders placed through the website www.torrinijewels.com are subject to acceptance by the Seller. The products displayed on the website www.torrinijewels.com that cannot be added to the cart are not available for sale. The Seller can providemore information on these products. Quantity limits may apply to orders forcertain products. We reserve the right to refuse orders over a certain number of advertised products at any time without notice.

ART. 3 - The orders, given the execution of the products "one by one, ad personam", will be considered binding, without the possibility of withdrawal, by both the Buyer and the Seller, unless motivated revocation to be notified by either party within 48 hours subsequent to successful pre-payment. The revocation of the order involves the assumption by the buyer of any costs relating to the payment practices as they occurred. The items covered by each order are handcrafted one by one by the Seller, therefore on commission, specific measure or customization for the Buyer and may slightly differ from the pictures of the items shown on the website www.torrinijewels.com due to the specific handcrafted process, which is followed.  The delivery time for orders, made up of hand-made items, is usually 3/6 weeks from the order confirmation, barring unforeseen circumstances; it can vary up to three / four months in the presence of special designs and processes and / or precious stones of a particular nature and cut.

ART. 4 -  Shipping is usually carried out by courier and takes place at the end of the manufacturing process. Insured shipments have indicative and non-binding delivery terms for the Seller. The Seller is not responsible for any direct or indirect damages, due to delays in delivery. Incase of non-receipt of the product by the Buyer, within thirty (30) days from the date of shipment or within any other time limit indicated, the Buyer may contact the Seller in writing to activate the consequent procedures related to the verification of objective responsibilities.

ART. 5 – Torrini 1369 export sales prices, fornon-EU citizens, never include import custom duties or local taxes, which vary from state to state. All applicable taxes, custom duties and other related charges are the responsibility of the Buyer. The recipient Purchaser is required to pay the amount established by the destination State and to give maximum cooperation to the Courier in charge of the delivery. If the recipient Purchaser does not collect the products sent by the Seller within the terms established by the Courier or rejects them by his/her choice, he/her assumes all the costs relating to their return to the Seller. The Seller will keep the product owned by the Purchaser available in its security facilities, in third-party deposit, for one year. If the return costs of the goods have not been reimbursed after this period, the goods will be auctioned off and the proceeds, minus the reimbursement of all costs incurred, will be kept available to the customer as a confirmatory deposit for another year. After this additional period, the remainder of the proceeds will be absorbed by the Seller as partial reimbursement of the damages suffered. Any negative publicity on social media of the story will authorize the Seller to appeal to the Court of Florence in defense of his civic and moral integrity. The payment of an order must be paid in advance following the methods indicated on the website www.torrinijewels.com.

ART. 6 - The Seller guarantees that all the products supplied comply with the intrinsic characteristics, information and images, shown on the site and / or in the certificate of origin when this is provided in the product kit. The Purchaser is required to report in writing to info@torrinishop.com, within a maximum period of 48 hours from the delivery to destination of the purchased product, except for adverse conditionsto be assessed, any discrepancy with respect to what is described or shown on the site. The Buyer will have the right to request the Seller to repair orreplace the purchased product in the event of a lack of conformity of the goods. A vague indication of non-compliance by the Buyer will not be considered valid. The Seller's intervention may only take place if the non-compliant products are returned within 20 days of receipt, with the box and the original Certificate of Origin, if part of the kit provided. The Seller declares that the Products are handcrafted and therefore must be considered, within the limits of normal tolerances, perfectly compliant with the items purchased. If proper observation of the item by an expert reveals severe manufacturing discrepancies, Seller will consider relevant appropriate written certification.

ART. 7 - The handcrafted products bearing the “Torrini 1369” trademark are usually accompanied by a Certificate of Origin and Authenticity. For all other products, in addition to those produced by third parties, the Seller only recognizes the "legal guarantee".

ART. 8- Pursuant to the Legislative Decree of the Italian Government (22 May1999, n.185, Article 5, paragraph 3, point c, of supply of goods produced on commission or made to measure), the Buyer cannot withdraw from the purchase, therefore the return of the purchased goods is not allowed, as it has stated several times, because these are exclusively Torrini 1369 luxury products, handcrafted one by one "ad personam", on commission, personalized or made to measure. Any request for any discrepancies with respect to the description and image on the website www.torrinijewels.com can be reported, within the terms set out in Art 6 and sent to info@torrinishop.com or by registered mail to the headquarters of Torrini Historic Shop – Torrini1369 S.r.l. - Piazza Duomo 12 / R - 50122 Florence - Italy.

ART. 9- The Seller is the sole official licensee of the know-how, trademarks and trade names relating to the Products called “Torrini 1369”.

ART. 10- For any dispute regarding these General Conditions of Sale, the Court of jurisdiction is that of Florence (IT)

*The Purchaser, subject to specification, expressly approves, pursuant to articles 1341 and 1342 of the Italian civil code the following articles of these general conditions of contract: Articles 1-2-5-8-10.
