Terms and Conditions of Sale
Version 1.16, last updated: October 1, 2026
Versione italianaArticle 1. The Seller
1.1 The website torrinijewels.com (the "Site") is operated by Torrini 1369 s.r.l., with registered office at Piazza del Duomo 12/R, 50122 Florence, Italy, VAT No. IT 06111170483, registered with the Florence Register of Companies (REA FI-601401), share capital €10,000.00 fully paid up, certified email (PEC) torrini1369@pec.it (the "Maison" or the "Seller").
1.2 For any request concerning an order or these Terms, the Client may contact the Maison by email at info@torrinijewels.com or by telephone at +39 055 2302401.
Article 2. Definitions
2.1 "Client": the natural person or legal entity who places an order through the Site.
2.2 "Consumer": a Client who is a natural person acting for purposes outside any trade, business, craft or profession they may carry on, within the meaning of the Italian Consumer Code (Legislative Decree No. 206 of September 6, 2005).
2.3 "Creation": any piece of jewelry offered on the Site, made to order in the configuration selected by the Client.
2.4 "Terms": these Terms and Conditions of Sale, in the version in force on the date of the order.
2.5 "Order Confirmation": the email by which the Maison accepts the Client's order under Article 5.2.
2.6 "Working Days": Monday through Friday, excluding Italian public holidays and the summer production closure, from August 7 to August 28.
Article 3. Scope and acceptance
3.1 These Terms govern all sales concluded through the Site between the Maison and the Client.
3.2 The Terms are made available to the Client, in a form that can be read and printed, on every page of the Site and through a visible link in the cart and at checkout. Before proceeding to payment, the Client expressly confirms, by means of a mandatory checkbox in the cart whose text links to these Terms, having read and accepted the Terms and Conditions of Sale and being aware that the Creation will be made to order, expressly for the Client.
3.3 Sales to Clients who purchase in the course of a trade, business or profession (including any purchase for which a VAT number or a company invoice is requested) are governed by Article 15; the provisions reserved for Consumers do not apply to such purchases.
Article 4. Creations made to order
4.1 No inventory. The Maison does not keep Creations in stock for sale through the Site. Each Creation, designed by the Maison, is made individually in Florence by master artisan goldsmiths to whom the Maison entrusts its making, upon the Client's order, in the configuration and, where applicable, in the size or length selected by the Client. Any pieces that may be on display in the Maison's boutique are not intended for distance sale: every order placed through the Site concerns exclusively a Creation to be made, within the time indicated in Article 8.
4.2 Configuration. Models set with gemstones are presented on the Site with the gemstone that characterizes them. Each model is made in the metal or metals indicated on the product page; where more than one is offered, the Client selects the one desired. The configurations offered are a selection of the combinations suggested by the Maison for that model and do not exhaust the possibilities for making it. Configurations other than those offered, such as a metal or a gemstone not listed, may be requested from the Maison by writing to info@torrinijewels.com before placing the order: where technically feasible, they are agreed upon and documented in writing and constitute, for all purposes, an individual production specification; for sizes not listed, Article 4.3 applies. In any event, no configuration is made before the order is placed: each Creation is produced, one by one, specifically on the basis of the Client's choice.
4.3 Size and length. All Creations, except earrings and models for which the product page does not provide for a size, require the selection of a size or a length, which constitutes a production specification: the Creation is made for the Client in the size indicated at the time of the order. If the desired size is not among those offered on the product page, the Client may request it by writing to the Maison at info@torrinijewels.com before placing the order: where technically feasible, the Creation will be made in the size agreed upon in writing, which constitutes, for all purposes, an individual production specification. A size guide and a pre-purchase advisory service are available to help the Client choose the correct size. The Client is asked to check the selected size with the greatest care before ordering: once made, many Creations do not allow the size to be altered and, where alterations are possible, they are limited (see Article 13.2).
4.4 Complimentary engraving. A personal engraving is offered free of charge on the models that allow it, in the space provided for it on each Creation. A Client who wishes to have one requests it in writing from the Maison at info@torrinijewels.com, either before placing the order or within the period set out in Article 5.7, in the manner described in Article 5.6: the agreed text is confirmed in writing by the Maison and constitutes, for all purposes, an individual production specification. The engraving is placed within the worked surface of the Creation, which is interrupted to make room for it; the Client is so informed in these Terms and when the text is agreed upon. The Maison reserves the right to decline, by notifying the Client, engraving texts that are offensive, unlawful or infringing on third-party rights, or that are incompatible with the space available on the Creation; in that case the Client may indicate an alternative text or forgo the engraving.
4.5 Images and handwork. The images on the Site illustrate a sample of the selected configuration. Each Creation is made by hand and, where gemstones are present, they are natural: the finished piece may show slight variations in the handwork and in the characteristics of the stones, which attest to the authenticity of the handwork and the uniqueness of the material. Such variations, disclosed in these Terms and on each product page, do not constitute a lack of conformity (see Article 12).
Article 5. Ordering procedure, conclusion of the contract and cancellation
5.1 An order placed by the Client through the Site constitutes an offer to purchase, governed by these Terms.
5.2 The contract is concluded when the Maison sends the Order Confirmation, which sets out: the Creation ordered, its configuration, the selected size or length, any engraving text, the price inclusive of taxes, the estimated delivery time, the record of acceptance of the Terms under Article 3.2, the right to cancel within 48 hours under Article 5.7 together with the notice that dedicated production will begin upon its expiry, the reference to the characteristics of the handwork referred to in Article 4.5 and, for Consumers, the notice of the exclusion of the right of withdrawal under Article 10. In the case of payment by bank transfer, the Order Confirmation is sent upon receipt of the funds (Article 7.1).
5.3 The Client is responsible for the accuracy of the information entered at the time of the order, including size and configuration, which are summarized before payment, as well as for any engraving text agreed upon in writing.
5.4 Cancellation by the Maison within 48 hours. Within 48 (forty-eight) hours of sending the Order Confirmation, the Maison may cancel the order, giving the Client prompt written notice, only in the following cases: (a) the payment details cannot be verified or there is a reasonable suspicion of fraud; (b) delivery to the indicated destination proves impossible or is not permitted under applicable law; (c) the material needed to make the Creation becomes unavailable. In such cases, any amount paid is refunded in full, without any deduction, by the same means of payment used by the Client, within 14 days of the notice. After that period, the Maison may cancel the order only in the cases provided for in Article 5.5.
5.5 If, after the contract has been concluded, making the Creation proves impossible (because natural gemstones with the characteristics described on the product page are unavailable, or due to unforeseeable events or force majeure), the Maison will promptly notify the Client in writing, stating the reason, and will, where possible, propose an alternative, such as a different selection of the gemstone or a new time frame for completion. Failing agreement, or if making the Creation remains impossible, the order will be canceled and any amount paid will be refunded in full by the same means of payment, within 14 days of the notice, at no further cost to the Client.
5.6 Changes requested by the Client. Within the period set out in Article 5.7, and in any event before production begins, the Client may request in writing a change to the order specifications, such as adding or amending the engraving text, or correcting a detail of the configuration or the size. The Maison reviews the request and, where technically feasible, confirms it in writing: the specifications so defined replace the original ones for all purposes of these Terms, and the periods under Articles 5.7 and 8.1 run anew from the written confirmation of the final specifications. After production has begun, any changes requested in writing by the Client may be considered by the Maison, where technically possible, with any adjustment to the delivery time and price communicated to the Client for acceptance; in this case too, the amended specifications replace the previous ones for all purposes.
5.7 Right to cancel within 48 hours. The Client may cancel the order, without giving any reason, within 48 (forty-eight) hours of the sending of the Order Confirmation, by written notice to the Maison at info@torrinijewels.com stating the order number. In that case the order is canceled and the amount paid is refunded, by the same means of payment used by the Client, within 14 days of receipt of the notice, net of the costs actually incurred by the Maison to receive and return the payment, which are indicated in the Order Confirmation and in any event do not exceed: 5% of the amount for payments by card or PayPal; €100 for bank transfers from accounts outside the SEPA area. Bank transfers from accounts within the SEPA area are refunded in full. Dedicated production of the Creation begins upon expiry of this period. Once the period has elapsed without the Client having exercised this right, the order becomes final: the Creation is made expressly for the Client and can no longer be canceled or returned, as provided in Articles 10 and 11. The right under this Article is granted by the Maison on a contractual basis to all Clients, wherever they reside; it neither constitutes nor replaces the right of withdrawal provided by the Italian Consumer Code for distance contracts, which is excluded for Creations made to order under Article 10.
Article 6. Prices
6.1 All prices shown on the Site are in euros (€) and include applicable taxes.
6.2 For deliveries to the destinations indicated in the Shipping Policy as "duties and taxes included," the price shown is final: no import duties or taxes will be charged to the Client upon delivery. For all other destinations, any import duties and taxes are borne by the Client, as specified in the Shipping Policy.
6.3 The price applicable to the order is the one published on the Site at the time the order is submitted.
6.4 In the event of an obvious error in the published price, recognizable as such in relation to the value of the Creation, the Maison may cancel the order within 48 (forty-eight) hours of sending the Order Confirmation, giving the Client prompt written notice and refunding in full any amount paid, without any deduction, by the same means of payment used by the Client, within 14 days of the notice.
Article 7. Payment
7.1 Payment is due in full at the time of the order, through the methods made available at checkout: payment cards (Visa, Mastercard, American Express, Cartes Bancaires, Postepay), PayPal and bank transfer. In the case of payment by bank transfer, the Maison notifies the Client that the order has been received, pending payment, and sends the Order Confirmation upon receipt of the funds: the period under Article 5.7 and the delivery time under Article 8.1 run from that moment. If the funds are not received within 7 days of the order, the order lapses, at no cost to the Client.
7.2 Payments are processed by secure, certified payment service providers. The Maison does not store the Client's full payment card details.
Article 8. Production and delivery times
8.1 Each Creation is made to order and delivered within 45 (forty-five) Working Days (Article 2.6), shipping included, from the Order Confirmation (or, where the specifications have been changed, from the written confirmation of the final specifications under Article 5.6); the period under Article 5.7 is included in this time. Certain types of work may require more time, as indicated on the relevant product page. Given the entirely handmade nature of each Creation, the Maison reserves the right to extend the delivery time by up to 10 (ten) additional Working Days, giving notice to the Client.
8.2 The delivery time reflects the nature of work carried out one piece at a time: the Maison will keep the Client informed of the shipment of the Creation and will provide tracking details at the time of dispatch.
8.3 The delivery conditions, insured shipping and the treatment of destinations are set out in the Shipping Policy, which forms an integral part of these Terms.
8.4 Should the indicated delivery time be significantly exceeded, the Maison will inform the Client and communicate the new expected date. The rights granted to Consumers by applicable law in the event of late delivery remain unaffected.
8.5 The risk of loss of or damage to the Creation passes to the Client when the Client, or a third party designated by the Client other than the carrier, takes physical possession of the Creation. Every shipment is insured through to delivery, as provided in the Shipping Policy; should the Creation be lost in transit, Section 5 of the Shipping Policy applies.
Article 9. Destinations
9.1 The Maison ships worldwide, except to destinations to which shipping is not permitted under applicable export regulations, on the conditions set out in the Shipping Policy in force at the time of the order, which distinguishes destinations with duties and taxes included from all other destinations.
9.2 For any question about a specific destination, including the applicable import charges, the Client may contact the Maison before ordering: we will be glad to provide the information available.
Article 10. Right of withdrawal (Consumers residing in the European Union, the European Economic Area and the United Kingdom)
10.1 Under Article 59(c) of the Italian Consumer Code (implementing Directive 2011/83/EU) and the corresponding provisions in force in the European Economic Area and the United Kingdom, the right of withdrawal is excluded for contracts for the supply of goods made to the consumer's specifications or clearly personalized, meaning non-prefabricated goods made on the basis of an individual choice of or decision by the consumer (Article 45(1)(d) of the Italian Consumer Code; Article 2(4) of Directive 2011/83/EU).
10.2 Creations are non-prefabricated goods made on the basis of the Client's individual choice: no Creation exists before the order, and each is made individually, upon the Client's order, in the model chosen by the Client, in the configuration selected from among those offered or agreed upon (Article 4.2), in the size indicated where provided for (Article 4.3) and, where requested, with a personal engraving. The Client is so informed before purchasing, on each product page and in the cart, through the confirmation referred to in Article 3.2. The right of withdrawal is therefore excluded for all Creations made to order under Article 4; the exclusion is confirmed in the Order Confirmation.
10.3 Earrings and Creations without a size. Earrings and other Creations for which no size selection is provided are likewise non-prefabricated goods: they are made individually upon the Client's order, in the model chosen by the Client and in the configuration selected or agreed upon under Article 4.2 and, where requested, with a personal engraving, and are not kept in stock. The exclusion under Article 10.2 therefore applies to these Creations as well.
10.4 Nothing in this Article limits the rights of Consumers under the legal guarantee of conformity (Article 12).
10.5 The right to cancel within 48 hours of the Order Confirmation under Article 5.7 remains unaffected.
Article 11. International orders (Clients residing outside the territories indicated in Article 10)
11.1 All sales of Creations made to order are final ("all sales are final on made-to-order pieces"), except for the right to cancel within 48 hours of the Order Confirmation under Article 5.7. Once that period has elapsed, since each Creation is produced individually upon the Client's order, orders cannot be canceled by the Client and Creations cannot be returned, subject only to any mandatory provisions that may apply in the Client's country of residence. The Maison's right to cancel the order in the cases provided for in Articles 5.4, 5.5 and 6.4 remains unaffected.
11.2 Article 13 (care and after-sales service) applies to all Clients, wherever they reside.
Article 12. Legal guarantee of conformity
12.1 Consumers benefit from the legal guarantee of conformity provided for in Articles 128 et seq. of the Italian Consumer Code, within the terms and with the remedies established by law.
12.2 To report a suspected lack of conformity, the Client may contact the Maison by email at info@torrinijewels.com or by telephone at +39 055 2302401, stating the order number and attaching photographic documentation. The Maison reviews the documentation and, where the defect appears plausible, arranges for the Creation to be picked up by insured shipping at its own expense; having examined the Creation, where the lack of conformity is confirmed, it applies the remedies provided by law. If the examination reveals no lack of conformity, the pickup and return shipping costs are borne by the Client, who is informed of this before pickup. The outcome of the examination is communicated to the Client in writing, with the reasons; it does not prejudice the rights granted to the Consumer by law and, in the event of disagreement, the Client may resort to the procedures referred to in Article 17.
12.3 Slight variations inherent in the handwork and the natural characteristics of the gemstones described in Article 4.5 do not constitute a lack of conformity. The legal guarantee also does not cover normal wear and tear, accidental damage, or damage resulting from improper use or from work carried out by third parties.
12.4 Purchases governed by Article 15 (professional Clients) are subject to the warranty regime of the Italian Civil Code (Articles 1490 et seq.); the shipping costs for the examination and return of the Creation are borne by the Client.
Article 13. Care and after-sales service
13.1 Each Creation is accompanied by the Torrini Certificate of Origin, which documents its configuration and authenticity. The Certificate is not an appraisal and does not constitute a valuation of the Creation's monetary value.
13.2 Each Creation is made in the size indicated by the Client at the time of the order, which constitutes a production specification. The Maison does not guarantee that the size can be altered once the Creation has been made: many Creations, by the nature of how they are made, do not allow it, and where technically possible the alteration is limited. For this reason, the Client is asked to check the size or length with the greatest care before ordering, using the size guide and the pre-purchase advisory service referred to in Article 4.3. Should the size received prove unsuitable, the Maison is available to assist the Client: any size adjustments, where technically feasible, are assessed case by case, at the Maison's discretion, on the conditions communicated to the Client before the work is carried out, and do not constitute a contractual obligation. The costs of insured shipping, both ways, and any import duties and taxes relating to sending the Creation for adjustment and to its return are borne exclusively by the Client, who is informed of this before shipping. The foregoing does not apply where the Creation was not made in the size indicated at the time of the order, in which case Article 12 applies.
13.3 The Maison remains at the Client's disposal over time for the care of the Creation (professional cleaning, checking of the prongs and stones), as part of its after-sales service.
Article 14. Intellectual property
14.1 The Torrini registered trademark, and the content, photographs, texts and designs published on the Site, are the exclusive property of the Maison or its licensors and may not be reproduced or used without prior written authorization. Further provisions are set out in the Website Terms of Use.
Article 15. Professional Clients
15.1 Purchases made in the course of a trade, business, craft or profession are governed by these Terms insofar as compatible and, for everything reserved for Consumers (including withdrawal and the legal guarantee of conformity), by the Italian Civil Code.
Article 16. Personal data
16.1 Personal data are processed in accordance with the Privacy Policy published on the Site.
Article 17. Governing law, jurisdiction and dispute resolution
17.1 These Terms are governed by Italian law, without prejudice to any more favorable mandatory provisions applicable to the Consumer under the law of the Consumer's country of habitual residence.
17.2 For disputes with Consumers residing in Italy, the court of the Consumer's place of residence or domicile has jurisdiction. For disputes with Consumers residing in another Member State of the European Union, in the European Economic Area, in Switzerland or in the United Kingdom, the mandatory rules on jurisdiction under applicable law remain unaffected. For any other dispute, including those with professional Clients (Article 15), the court of Florence has exclusive jurisdiction, subject to any applicable mandatory provisions.
17.3 In the event of a dispute, the Consumer may resort to the alternative dispute resolution (ADR) procedures provided for by applicable law. Information on the competent bodies is available by contacting the Maison by email at info@torrinijewels.com.
17.4 Should any individual provision of these Terms be invalid or unenforceable, the validity of the remaining provisions is not affected, and they remain in full force and effect.
Article 18. Amendments, versions and language
18.1 The Maison may amend these Terms at any time. Each order is governed by the version of the Terms in force and published on the Site on the date of the order. Each published version bears a version number and date; previous versions are archived by the Maison together with their period of validity.
18.2 These Terms are drawn up in Italian; the English version published on the Site is a translation. In the event of any discrepancy between the two versions, the Italian version prevails.
