GENERAL CONDITIONS OF ONLINE SALE

ART. 1 - The application of the general conditions of sale is limited to goods purchased at the online shop ("www.torrinijewels.com") owned and managed by Torrini 1369 srl, official licensee of the "Torrini 1369" Trademark, resident in Piazza Duomo 12 R in Florence (IT), (here in after referred to as the Seller), by individuals persons (here in after referred to as Buyers) who act for purposes not relevant to their business or professional activity, who must be considered end users or consumers: (a) who have reached the age of majority required to enter into purchase contracts (eighteen in most countries); (b) who have the legal capacity to enter into purchase contracts; (c) that use a shipping address in the country or countries we ship to. Unless otherwise provided, minors do not enjoy the right to legally stipulate a purchase contract and are required to use their parent or legal guardian to transmit an order in their own name and will be required to accept these Conditions of sale. Any changes may be made from time to time to these General Conditions of Sale; therefore, please check them regularly to keep informed of updates. The latest version of these General Conditions of Sale will always be available on the official website www.torrinijewels.com. Any new version of these General Conditions of Sale will take effect immediately on the date of shipment and will govern orders for products or services made from that date. Changes to the Conditions of Sale subsequent to the transmission of the order will not affect the order or the relationship with us, except as may be required by applicable law.
ART. 2 - All orders placed through the website www.torrinijewels.com are subject to acceptance by the Seller. The products displayed on the website www.torrinijewels.com that cannot be added to the cart are not available for sale. The Seller can provide more information on these products. Quantity limits may apply to orders for certain products. We reserve the right to refuse orders over a certain number of advertised products at any time without notice.
ART. 3 - The orders, given the execution of the products "one by one, ad personam", will be considered binding, without the possibility of withdrawal, by both the Buyer and the Seller, unless motivated revocation to be notified by either party within 48 hours subsequent to successful pre-payment. The revocation of the order involves the assumption by the buyer of any costs relating to the payment practices as they occurred. The items covered by each order are handcrafted one by one by the Seller, therefore on commission, specific measure or customization for the Buyer and may slightly differ from the pictures of the items shown on the website www.torrinijewels.com due to the specific handcrafted process, which is followed. The delivery time for orders, made up of hand-made items, is usually 3/6 weeks from the order confirmation, barring unforeseen circumstances; it can vary up to three / four months in the presence of special designs and processes and / or precious stones of a particular nature and cut.
ART. 4 - Shipping is usually carried out by courier and takes place at the end of the manufacturing process. Insured shipments have indicative and non-binding delivery terms for the Seller. The Seller is not responsible for any direct or indirect damages, due to delays in delivery. In case of non-receipt of the product by the Buyer, within thirty (30) days from the date of shipment or within any other time limit indicated, the Buyer may contact the Seller in writing to activate the consequent procedures related to the verification of objective responsibilities.
ART. 5 – Torrini 1369 export sales prices, for non-EU citizens, never include import custom duties or local taxes, which vary from state to state. All applicable taxes, custom duties and other related charges are the responsibility of the Buyer. The recipient Purchaser is required to pay the amount established by the destination State and to give maximum cooperation to the Courier in charge of the delivery. If the recipient Purchaser does not collect the products sent by the Seller within the terms established by the Courier or rejects them by his/her choice, he/her assumes all the costs relating to their return to the Seller. The Seller will keep the product owned by the Purchaser available in its security facilities, in third-party deposit, for one year. If the return costs of the goods have not been reimbursed after this period, the goods will be auctioned off and the proceeds, minus the reimbursement of all costs incurred, will be kept available to the customer as a confirmatory deposit for another year. After this additional period, the remainder of the proceeds will be absorbed by the Seller as partial reimbursement of the damages suffered. Any negative publicity on social media of the story will authorize the Seller to appeal to the Court of Florence in defense of his civic and moral integrity. The payment of an order must be paid in advance following the methods indicated on the website www.torrinijewels.com.
ART. 6 - The Seller guarantees that all the products supplied comply with the intrinsic characteristics, information and images, shown on the site and / or in the certificate of origin when this is provided in the product kit. The Purchaser is required to report in writing to info@torrinishop.com, within a maximum period of 48 hours from the delivery to destination of the purchased product, except for adverse conditions to be assessed, any discrepancy with respect to what is described or shown on the site. The Buyer will have the right to request the Seller to repair orreplace the purchased product in the event of a lack of conformity of the goods. A vague indication of non-compliance by the Buyer will not be considered valid. The Seller's intervention may only take place if the non-compliant products are returned within 20 days of receipt, with the box and the original Certificate of Origin, if part of the kit provided. The Seller declares that the Products are handcrafted and therefore must be considered, within the limits of normal tolerances, perfectly compliant with the items purchased. If proper observation of the item by an expert reveals severe manufacturing discrepancies, Seller will consider relevant appropriate written certification.
ART. 7 - The handcrafted products bearing the “Torrini 1369” trademark are usually accompanied by a Certificate of Origin and Authenticity. For all other products, in addition to those produced by third parties, the Seller only recognizes the "legal guarantee".
ART. 8- Pursuant to the Legislative Decree of the Italian Government (22 May1999, n.185, Article 5, paragraph 3, point c, of supply of goods produced on commission or made to measure), the Buyer cannot withdraw from the purchase, therefore the return of the purchased goods is not allowed, as it has stated several times, because these are exclusively Torrini 1369 luxury products, handcrafted one by one "ad personam", on commission, personalized or made to measure. Any request for any discrepancies with respect to the description and image on the website www.torrinijewels.com can be reported, within the terms set out in Art 6 and sent to info@torrinishop.com or by registered mail to the headquarters of Torrini Historic Shop – Torrini1369 S.r.l. - Piazza Duomo 12 / R - 50122 Florence - Italy.
ART. 9- The Seller is the sole official licensee of the know-how, trademarks and trade names relating to the Products called “Torrini 1369”.
ART. 10- For any dispute regarding these General Conditions of Sale, the Court of jurisdiction is that of Florence (IT)

ART. 1 - L'applicazione delle condizioni generali di vendita è limitata ai beni acquistati presso lo shop online (“www.torrinijewels.com”) di proprietà e gestito da Torrini 1369 Srl, licenziataria del Marchio “Torrini 1369”, residente in Piazza Duomo 12 R a Firenze (IT), (di seguito denominato Venditore), da persone fisiche (di seguito chiamate Acquirenti) che agiscono per scopi non pertinenti alla loro attività imprenditoriale o professionale, che devono essere considerati utenti finali o consumatori:(a) che abbiano raggiunto la maggiore età richiesta per stipulare contratti di acquisto (diciotto nella maggior parte dei paesi); (b) che abbiano la capacità giuridica di stipulare contratti di acquisto; (c) che utilizzino un indirizzo di spedizione nel Paese o nei Paesi in cui spediamo. I soggetti minori di età, salvo che sia diversamente disposto, non godono della facoltà di stipulare legittimamente un contratto d’acquisto e sono tenuti ad avvalersi del genitore o del tutore legale per trasmettere un ordine a proprio nome e saranno tenuti ad accettare le presenti Condizioni Generali di vendita. Eventuali modifiche potranno essere apportare di volta in volta alle presenti Condizioni Generali di vendita; si prega pertanto di controllarle regolarmente per tenersi informati sugli aggiornamenti. Sul sito ufficiale www.torrinijewels.com sarà sempre disponibile l'ultima versione delle presenti Condizioni Generali di Vendita. Qualsiasi nuova versione delle presenti Condizioni Generali di vendita avrà effetto immediato alla data di spedizione e disciplinerà gli ordini dei prodotti o servizi effettuati a decorrere da tale data. Le modifiche alle Condizioni Generali di vendita successive alla trasmissione dell'ordine non incideranno sull'ordine o sulla relazione nei nostri confronti, salvo quanto eventualmente previsto dalla legge applicabile.
ART. 2 - Tutti gli ordini effettuati attraverso il sito www.torrinijewels.com sono soggetti all'accettazione da parte del Venditore. I prodotti visualizzati sul sito www.torrinijewels.com che non possono essere aggiunti al carrello non sono disponibili per la vendita. Il Venditore può fornire maggiori informazioni su tali prodotti. Limiti quantitativi possono essere applicati agli ordini di determinati prodotti. Ci riserviamo il diritto di rifiutare in qualsiasi momento, senza preavviso, ordini superiori a un certo numero di prodotti pubblicizzati.
ART. 3 - Tutti gli ordini effettuati attraverso il sito www.torrinijewels.com sono soggetti all'accettazione da parte del Venditore. I prodotti visualizzati sul sito www.torrinijewels.com che non possono essere aggiunti al carrello non sono disponibili per la vendita. Il Venditore può fornire maggiori informazioni su tali prodotti. Limiti quantitativi possono essere applicati agli ordini di determinati prodotti. Ci riserviamo il diritto di rifiutare in qualsiasi momento, senza preavviso, ordini superiori a un certo numero di prodotti pubblicizzati.
ART. 4 - La spedizione vengono effettuate usualmente per Corriere e avviene al termine del processo di manifattura. Le spedizioni assicurate hanno termini di consegna indicativi e non vincolanti per il Venditore. Il Venditore non è responsabile per eventuali danni diretti o indiretti, dovuti a ritardi nella consegna. In caso di mancata ricezione del prodotto da parte dell’Acquirente, entro trenta (30) giorni dalla data della spedizione o entro qualsiasi altro limite di tempo indicato, l’Acquirente potrà contattare per iscritto il Venditore per attivare le conseguenti procedure legate alla verifica delle responsabilità oggettive.
ART. 5 - I prezzi export Torrini 1369 per i non residenti in UE, non includono mai i dazi doganali all'importazione o le tasse locali, che variano da Stato a Stato. L’Acquirente destinatario è tenuto a pagare quanto stabilito dallo Stato di destinazione e di dare la massima collaborazione al Corriere incaricato della consegna. Qualora l’Acquirente destinatario non proceda nei termini previsti dal Corriere al ritiro dei prodotti inviati dal Venditore o li respinga per sua scelta, si assume tutti i costi relativi al rientro di essi presso il Venditore. Il Venditore terrà a disposizione presso le proprie strutture di sicurezza, in deposito conto terzi, i/il prodotti/o di proprietà dell’Acquirente per un anno. Trascorso tale termine senza che siano stati rimborsati i costi di ritorno della merce, essa verrà posta all’asta e il ricavato, sottratto il rimborso di tutti i costi sostenuti, sarà tenuto adisposizione del cliente come caparra confirmatoria per un altro anno. Trascorso tale ulteriore periodo il residuo del ricavato sarà assorbito dal Venditore quale parziale rifusione dei danni subiti. La eventuale negativa pubblicizzazione sui social/media della vicenda autorizzerà il Venditore a ricorrere al Tribunale di Firenze a difesa della sua integrità civica e morale.
ART. 6 - Il Venditore garantisce che tutti i prodotti forniti sono conformi alle caratteristiche intrinseche, informazioni ed immagini, riportate nel sito e/o nel certificato di origine quando questo è previsto nel kit del prodotto. L'Acquirente è tenuto a segnalare per iscritto a info@torrinishop.com, entro un termine massimo di 48 ore dalla consegna del prodotto acquistato, salve condizioni avverse da porre in valutazione, qualsiasi difformità rispetto a quanto descritto o mostrato nel sito. L'Acquirente avrà facoltà di richiedere al Venditore la riparazione o la sostituzione del prodotto acquistato in caso di difetto di conformità del bene. Non sarà ritenuta valida una vaga indicazione di non conformità da parte dell'Acquirente. L'intervento del Venditore potrà avere luogo solo se i prodotti non conformi vengono restituiti entro 20 giorni dalla ricezione con il pacco e il certificato di Origine originale, se parte del kit fornito. Il Venditore dichiara che i Prodotti sono realizzati artigianalmente e pertanto devono ritenersi, nei limiti delle normali tolleranze, perfettamente conformi agli articoli acquistati. Se un'appropriata osservazione dell'articolo da parte di un esperto rivela forti discrepanze di fabbricazione, il Venditore metterà in valutazione la relativa appropriata certificazione scritta.
ART. 7 - I prodotti artigianali realizzati con il Marchio “Torrini 1369” sono normalmente accompagnati da Certificato di Origine e Autenticità. Per tutti gli altri prodotti, oltre a quelli prodotti da terzi, il Venditore riconosce esclusivamente la "garanzia legale".
ART. 8 - Ai sensi del Decreto Legislativo del Governo Italiano (22 maggio 1999, n. 185, articolo5, comma 3, punto c, di fornitura di beni prodotti su commissione o su misura), l'Acquirente non può recedere dall'acquisto, pertanto non è consentita la restituzione del bene acquistato in quanto si tratta, come più volte affermato, esclusivamente di prodotti di lusso Torrini 1369, realizzati di volta in volta "ad personam" su commissione, personalizzati o su misura. Ogni richiesta di difformità rispetto alla descrizione e all'immagine presente sul sito www.torrinijewels.com potrà essere segnalata, entro i termini di cui all'Art. 6, e inviato a info@torrinishop.com o tramite raccomandata AR alla sede di Torrini Negozio Storico– Torrini 1369 S.r.l. - Piazza Duomo 12 / R - 50122 Firenze - Italia.
ART. 9- Il Venditore è il solo licenziatario ufficiale del know-how, dei marchi e dei nomi commerciali relativi ai Prodotti denominati “Torrini 1369”.
ART. 10- Per ogni controversia alle presenti Condizioni Generali di Vendita il Foro di competenza è quello di Firenze (IT)
